【Malaysia Company Registration Tips】 Understanding Malaysia Trademark Registration MyIPO and Precautions
The Malaysian Intellectual Property Office (MyIPO) manages and regulates trademark registration in Malaysia. Trademarks are an important part of a company's branding, distinguishing its goods or services from those of other companies.
There are two ways to register a trademark in Malaysia: manually filling out forms and submitting them in person, or submitting them online through the official MyIPO website.

The trademark registration process usually takes a considerable amount of time, approximately 9 to 15 months to complete. During the trademark registration process, it is also necessary to note some types of trademarks that cannot be registered such as those that are likely to cause confusion or mislead the public, contain scandalous or offensive content, or may harm national interests or security.

Registered trademarks are valid from the date of application for a period of ten years and can be renewed every ten years. Trademark registration and renewal are crucial for businesses to protect their brands and intellectual property.
Why is trademark registration important for businesses?
1. Proprietary Rights - The registered trademark owner has the exclusive right to use their trademark in trade. The trademark owner has the right to sue others for unauthorized use of their trademark under the Trade Marks Act, and may also pursue civil action or lodge a complaint with law enforcement for appropriate action under the Merchandise Marks Act 1972.
2. Legal Evidence - The certificate of registration issued by the Registry is prima facie evidence of trademark ownership. The certificate of registration is an important document for establishing ownership of goods exported to other countries.
