Key Time Nodes
Financial and tax compliance is critical in Malaysia. Ensuring timely submission of necessary returns and documents helps businesses avoid fines and legal risks. Here are the main tax filing deadlines for businesses in Malaysia:
1. Estimated Tax Return (Submission of Form CP204)
- Filing Requirements: All companies must submit estimated taxes within one month before the start of the next fiscal year (unless exempted under specific conditions).
- Example: If a company's fiscal year ends on December 31, 2023, the return must be completed by November 30, 2022.
2. Corporate Income Tax Return
- Annual Filing Time: Companies must submit their corporate income tax return (Form C) within the stipulated timeframe each year.
- Example: Usually within 7 months after the end of the fiscal year, the specific time depends on the company's fiscal year.
3. Sales and Services Tax (SST) Return
- Filing Cycle: Eligible companies must submit SST returns to the Royal Malaysian Customs Department (RMCD). The first SST return is due one month after successful application, followed by bimonthly returns (based on the effective date given by the Inland Revenue Board).
- Example: If the effective date is February 1, 2023, the first return will be on March 31, 2023; the March and April 2023 returns will be due in May, and so on.
4. Financial Statement Submission
- Required Parties: Private limited companies and listed companies must submit their annual financial statements to the Companies Commission of Malaysia (SSM) within eight months of the end of their fiscal year.
- Example: If the fiscal year ends on December 31, the submission must be completed by July 31 of the following year.
